TERMS AND CONDITIONS OF HIRE
DEFINITIONS
“Committee” shall mean any member(s) of the Billington Hall Village Committee.
“Hirer” shall mean the applicant named on the Booking. If the hire is for an organisation the applicant must be it authorised representative.
“Hall” shall mean the Billington Village hall premises including the adjoining car park. The playing field is NOT part of the premises. Hirers use the playing field at their own risk and The Billington Hall Village Committee do not accept any liability for any loss or damage.
1. APPLICATION
The application for hire must be made on the booking form which will be sent to the hirer once the enquiry has been made and the availability of the hall determined. The committee reserves the right to refuse to accept an application for hire.
2. HIRE CHARGE
Rates are as given on enquiry.
3. CANCELLATION
A Hirer may cancel a booking not later than twenty-eight days’ notice to the Committee and receive a full refund of the hire fee paid (if any). If the booking is cancelled later than 28 days prior to the date of hire the hirer remains liable for the full hire charge.
4. PERIOD OF USE
Possession – The Hirer shall be entitled to possession only upon the days and at the times for which the Hall has been booked.
Access at other times – The Committee does not undertake the safe custody of the Hirer’s property.
5. PROHIBITED USES
Auction Sales and Trade Exhibitions are not permitted in the Hall under normal terms of hire but, if permitted, will be subject to special charges and conditions of hire that the Committee may decide at the time of the booking.
Livestock – No animal or livestock (other than guide dogs) are allowed in the Hall building without the express permission of the Committee. Fowl, birds, rodents, and reptiles must be caged or similarly contained.
Dangerous Substances and Articles – The following may not be brought into the Hall, e.g. any inflammable or explosives such as cylinders for filling helium balloons, fireworks, aerosol streamers, offensive weapons and any articles producing an offensive smell, smoke producing canisters or steam, gas, or other working engines. Certain stage effects in this category may be allowed under controlled conditions but must be agreed by the Committee. Festive decorations must be of fireproof type.
Fittings etc. – No fittings or fixtures may be removed. Anything that may in any way damage the interior of the Hall o the furniture such, for instance, as driving nails into walls, floors or furniture is strictly forbidden.
6. SUB-LETTINGS
A Hirer may not sub-let the Hall. The Hirer named on the application form shall be present at all times during the period of hire.
7. CONDITIONS AFTER USE
If the Hall and any other parts of the premises to which the Hirer has access are, in the opinion of the Committee, left in an unreasonably dirty condition, an additional charge will be made for cleaning. The Hirer’s deposit may be forfeited to cover such cost as the Committee may incur.
8. DAMAGE
The hirer shall be responsible and shall pay on demand for any damage to the Hall or to any property of the Committee during the hire and shall indemnify the Committee against any claims by third parties for damage or loss arising from the Hirer’s use of the Hall.
The Hirer’s deposit shall be forfeited in all cases. Repair costs exceeding the deposit value shall be payable by the Hirer.
9. LIGHTING
Other than on the Stage, no addition may be made to the lighting already provided. Extra light fittings may be used on the Stage only at the discretion of the Committee.
10. USE OF AMPLIFYING EQUIPMENT
To avoid complaints from local residents any sound appliances must be kept to the minimum necessary for audibility within the Hall.
The use of amplifying equipment is prohibited after 11.30pm. If these restrictions are not applied the Committee reserve the right to stop proceedings.
11. COPYRIGHT
Indemnification – A Hirer shall not infringe copyright and will indemnify the Committee against all proceedings or claims made against the committee by reason of any infringement occurring during the period of Hire.
Royalties – The Hirer is responsible for obtaining Performing Licenses and for the payment of Royalties.
12. SALE OF INTOXICANTS
No intoxicants may be sold on the premises.
13. ATTENDANCE OF FIREMEN OR POLICE
If, in the opinion of the Committee, the attendance of firefighters or police is necessary during any period of hire, the Hirer will be required to pay for any charges incurred.
14. EXITS AND PASSAGES
The gangways and passageways must be kept free from obstructions. Chairs or table must not be placed in the gangways or in front of fire exits. It is the responsibility of the Hirer to ensure that fire exits are in an unlocked condition when the Hall is in use.
15. ENFORCEMENT OF REGULATIONS, STEWARDS
- Committee Representatives are instructed to see that these Regulations are observed and to do everything necessary to prevent risk of damage from fire or other cause. The Hirer is, in particular, to comply with the instructions of the Representative in respect of the use of the Hall and for action for prevention of damage, disorder, etc.
- The Hirer will be responsible for maintaining good order in the Hall and, for this purpose, to assist in carrying out the Regulations, shall provide a sufficient number of The Hirer, or representative, is to be personally present in the Hall for the duration of the function. At all public functions, at least two Stewards are to be in attendance in the Hall.
16. RIGHT OF ENTRY
The Committee reserves the right of entry for their Officers and authorised members to all parts of the Hall at all times. Employees of the Hirer must be instructed accordingly.
17. LETTING INVOLVING STATUTORY OBLIGATIONS
The Hirer must observe and perform all statutory provisions and regulations and conditions imposed by the Licensing Authority and indemnify the Committee for all penalties which they may incur in consequence of any default.
18. ACCIDENTS
In the case of any accident or breakdown whatsoever, rendering necessary the temporary closure of the Hall or any interruption for any repairs or renewals consequent on any such breakdown or accident, the Committee shall not be liable for any compensation of loss.
